General Terms and Conditions
of ALPINE BEAUTY Switzerland GmbH
1. Validity of the GTC and conclusion of contract
1.1 These General Terms and Conditions (hereinafter referred to as the "GTC") apply to purchase contracts with private customers and companies that are concluded via the www.alpine-beauty.swiss online shop (hereinafter referred to as the "Online Shop"). The Online Shop is operated by ALPINE BEAUTY Switzerland GmbH (hereinafter referred to as "ALPINE BEAUTY").
The offering of products and services in the Online Shop (hereinafter referred to as the "Offering") is available exclusively to customers domiciled outside of Switzerland, Liechtenstein, and the EU (hereinafter referred to as the "Customer").
Deliveries are made exclusively to addresses OUTSIDE of Switzerland, Liechtenstein, and the EU.
1.2 The order shall be confirmed by ALPINE BEAUTY. The contract is deemed concluded as soon as the Customer receives the confirmation via e-mail. If no confirmation is received within a reasonable period, the Customer should consider this as a rejection of the order and shall be entitled to conclude the contract with another supplier.
1.3 ALPINE BEAUTY reserves the right to change these GTC at any time. The applicable version of the GTC at the time of the order is authoritative and cannot be unilaterally modified for this order. Customer GTC that conflict with these GTC will not be accepted.
2. Prices and special offers
2.1 Prices are listed in USD as export prices without VAT and custom duty in the country of the Customer’s domicile (if applicable). Handling is included. Shipping costs will be listed separately if these are charged to the Customer.
2.2 ALPINE BEAUTY reserves the right to change the prices at any time. The prices published on the website on the date of the order will be authoritative for the Customer.
2.3 The conditions for promotions and discounts will be listed with the relevant information.
2.4 The offer will be valid as long as the product can be found via the Online Shop search and/or supplies last.
3. Terms of delivery
3.1 Orders will be dispatched as soon as possible. The Customer may consult the delivery status online at any time. Due to production and delivery bottlenecks, however, delivery delays may occur. All information on availability and delivery time will therefore be subject to change at any time.
4. Inspection requirement
4.1 The Customer shall immediately inspect the delivered products for correctness, completeness, and potential delivery damage. In case of issues, the Customer may contact customer service at help@alpine-beauty.swiss.
5. Liability, warranty and returns
5.1 The rules of the Swiss Code of Obligations (OR Law from 1.1.2013) , especially the Art. 210 and Art. 371 are applicable.
The supplier shall guarantee, for a period of 24 months, that the goods are free of any defects that may impair their value or suitability for the intended use and that they meet the prescribed specifications and performance standards.
5.2 In the event of a defect, the Customers is entitled to demand free repair, deduct an amount corresponding to the reduction in value from the payment made to ALPINE BEAUTY, withdraw from the contract and return the goods, or demand a replacement of the faulty product.
6. Payment
6.1 Payment can only be made using the methods listed in the Online Shop. In the event of payment by credit card or other immediate payment means, the charge will occur at the time of ordering.
7. Liability for online connections
7.1 ALPINE BEAUTY shall undertake to ensure the security of the systems, programs, etc. that are owned by it or on which it has an influence, in line with current technical standards, as well as to observe the regulations concerning data protection.
7.2 The Customer shall ensure the security of the systems, programs, and data within his/her sphere of influence. For his/her own protection, the Customer shall keep passwords and user names confidential from third parties.
7.3 ALPINE BEAUTY shall not be liable for defects and disruptions not caused by it and, above all, for any safety deficiencies and operating failures of third parties with which it cooperates or on which it depends.
7.4 Furthermore, ALPINE BEAUTY shall not be liable for force majeure events, improper handling and disregard of the risks on the part of the Customer or third parties, excessive use, unsuitable means of operation employed by the Customer or third parties, extreme environmental conditions, interventions by the Customer or interferences by third parties (viruses, hacker attacks, etc.), which may occur despite the necessary current security precautions.
8. Application of law and jurisdiction
8.1 These GTC are governed by the substantive law of Switzerland. Vienna Sales Law is not applicable.
8.2 Foreign customers may choose the jurisdiction of the courts located at the domicile of the Customer or at the headquarters of ALPINE BEAUTY. The courts with jurisdiction at the domicile of the Customer shall be responsible in the event that ALPINE BEAUTY takes action against the Customer.
8.3 In the event of legal disputes, the German version of the GTC is authoritative.
9. Date protection
9.1 The data privacy statement under Disclaimer is an integral part of these GTC. By accepting these GTC, the Customer declares that he/she also agreed to the conditions of the Disclaimer.
